Welcome to the website of the Asia-Pacific Broadcasting Union (“ABU”, “we”, “us” or “our”).
These Terms and Conditions (“Terms”) govern access to and use of the ABU website, member portal, online applications and other online services made available by ABU through its digital platforms (collectively, the “Services”).
These Terms apply to users of the Services, including representatives of ABU members, associate and affiliate members, event participants, speakers, contributors and members of the public.
By accessing or using the Services, creating an account or registering for an event through the Services, you agree to be bound by these Terms to the extent applicable to the relevant activity. Where a separate agreement, event-specific condition or other applicable term governs a particular service or activity, that agreement or condition shall apply to the extent of any inconsistency with these Terms.
If you do not agree to these Terms, you should discontinue use of the relevant Services.
You must have the legal capacity required under applicable law to enter into a binding agreement to use the Services.
Where you access or use the Services on behalf of an organisation, you represent that you are authorised to act on its behalf in relation to that use. References to “you” and “your” shall, where appropriate, include both the individual user and the organisation represented by that user.
Where a user does not have the legal capacity to enter into a binding agreement, access to or use of the relevant Services must be undertaken only where permitted by applicable law and with any required consent or supervision of a parent, legal guardian or other authorised person.
You agree to provide accurate and complete information when registering for an account or an event and to update that information where reasonably necessary.
Certain Services, including the member portal and event-registration facilities, may require account registration or authentication.
Where an account is required, you agree to:
Accounts and access credentials must not be transferred, shared or used by another person except as authorised by ABU or permitted under the applicable account arrangements.
ABU may implement reasonable measures to verify identity, manage access permissions and protect the security and integrity of the Services.
You remain responsible for activities undertaken through your account to the extent attributable to your acts or omissions, including any failure to comply with these Terms. ABU’s liability in connection with unauthorised account access shall be determined in accordance with Section 15 and applicable law.
ABU membership, including the applicable membership categories, eligibility requirements, admission procedures, rights and obligations, shall be governed by ABU’s Statutes and the applicable membership rules, regulations and decisions of its competent governing bodies.
These Terms govern the use of the Services and do not, by themselves, confer membership of ABU or create any right to admission, continued membership, participation in ABU governance or access to member-only services.
Applications for membership and matters concerning membership status shall be dealt with in accordance with the applicable ABU governing instruments and procedures.
Where a member’s representative is granted access to the member portal or other member-only Services, that access may be subject to verification of the representative’s authority and the relevant membership or access arrangements.
Nothing in these Terms shall be interpreted as amending or overriding ABU’s Statutes or applicable membership rules.
ABU may make available online registration for conferences, meetings, workshops, competitions and other events organised, hosted or supported by ABU.
Event registration may be subject to availability, eligibility requirements, registration deadlines, fees and event-specific conditions.
Registration does not guarantee admission or participation unless confirmed by ABU or otherwise specified in the applicable event conditions.
ABU may refuse, cancel or modify an event registration where reasonably necessary, including for capacity, eligibility, security, administrative or other legitimate operational reasons, subject to applicable law and any applicable contractual commitments.
ABU may also amend, postpone or cancel an event where circumstances reasonably require it. Where an event is cancelled, postponed or materially changed, ABU shall communicate relevant information to registered participants and address any applicable refund or other entitlement in accordance with the event-specific conditions and applicable law.
Any recording, photography, broadcasting, publication or other use of a participant’s image, voice or contribution shall be subject to the applicable event notices, consents, agreements and legal requirements.
You agree to use the Services lawfully and responsibly and not to:
ABU may take reasonable and proportionate measures to address suspected breaches of this Section, including restricting access to affected content or functionality.
Certain Services may permit users to submit comments, forum posts, profile information, documents, photographs, videos or other materials (“User Content”).
You retain ownership of your User Content. By submitting User Content through the Services, you grant ABU a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and otherwise use that User Content to the extent reasonably necessary to operate, administer and provide the relevant Services and, where applicable, to communicate or promote ABU’s activities.
The licence under this Section shall apply only to the purposes described above and shall not transfer ownership of your User Content to ABU. Any use of User Content beyond those purposes may require a separate permission, agreement or other legal basis.
You represent that you have the rights, permissions and authority necessary to submit your User Content and to grant the licence described in this Section.
You are responsible for ensuring that your User Content does not violate applicable law, infringe third-party rights or breach any confidentiality obligation applicable to you.
ABU may review, moderate, restrict or remove User Content where reasonably necessary to comply with applicable law, protect third-party rights, maintain the integrity of the Services or address a breach of these Terms. ABU is not obliged to monitor all User Content or to publish any particular submission.
Where User Content is submitted on behalf of an organisation, the individual submitting it must have the necessary authority to do so.
Unless otherwise stated, the content and materials made available through the Services, including text, publications, reports, graphics, photographs, videos, logos, designs, software and the ABU name and branding, are owned by ABU or its licensors and are protected by applicable intellectual property laws.
Subject to any specific terms accompanying particular materials, you may access and use the content for lawful personal, informational or internal institutional purposes.
Except as permitted by applicable law or expressly authorised in writing by ABU or the relevant rights holder, you must not reproduce, distribute, publicly communicate, commercially exploit, modify or create derivative works from materials made available through the Services.
Nothing in these Terms transfers ownership of ABU’s intellectual property to you or grants you any right to use ABU’s name, logo or other branding in a manner that suggests endorsement, affiliation or authorisation without the necessary permission.
Materials belonging to third parties remain subject to the rights and conditions applicable to those materials.
The Services may contain links to or integrate with third-party websites, platforms or services, including payment processors and external registration systems.
Such links or integrations are provided for convenience or operational purposes. Unless expressly stated otherwise, they do not constitute an endorsement by ABU of the relevant third party or its products, services, content or policies.
ABU does not control third-party services and is not responsible for their independent content, availability, security or data-handling practices, subject to any obligations that ABU may have under applicable law or a separate agreement.
Your use of a third-party service may be governed by that provider’s terms and privacy policy. You should review those terms before using the relevant service.
Fees may apply to designated events, activities or other Services. Applicable fees, payment deadlines, accepted payment methods and any additional conditions shall be specified at the relevant point of registration or in the applicable agreement or event conditions.
Unless otherwise specified, fees shall be payable in the currency stated at registration and must be paid in accordance with the stated payment arrangements.
Cancellation, withdrawal, refund and transfer arrangements shall be governed by the applicable event conditions or separate agreement and applicable law.
Payments processed through third-party payment providers may also be subject to the providers’ applicable terms.
Nothing in this Section excludes any refund or other entitlement that cannot lawfully be excluded.
ABU’s collection, use, disclosure, storage and other processing of personal information in connection with the Services shall be governed by ABU’s Privacy Policy. The Privacy Policy should be read together with these Terms.
ABU shall handle personal information in accordance with the applicable privacy and data-protection requirements. Where consent is required by applicable law for a particular processing activity, ABU shall obtain that consent through an appropriate mechanism.
Use of the Services does not, by itself, constitute consent to every possible use of personal information. Any additional consent, notice or authorisation required for a particular activity shall be addressed separately where applicable.
ABU may suspend, restrict or terminate access to an account or particular Services where reasonably necessary, including where:
Where reasonably practicable and appropriate, ABU shall provide notice of the action taken and an opportunity to address the relevant issue. ABU may act without prior notice where necessary to address an immediate security risk, suspected unlawful activity or other urgent circumstances.
Where appropriate, ABU may consider requests to review an access restriction.
Suspension or termination of access to the Services does not, by itself, determine or terminate a person’s membership of ABU or alter any rights governed by ABU’s Statutes or applicable membership rules.
Termination of access shall not affect rights or obligations that have accrued before termination or provisions that are intended by their nature to continue in effect.
ABU will take reasonable steps to maintain the availability and proper functioning of the Services. However, the Services may occasionally be unavailable, interrupted, delayed or subject to maintenance, technical failures or security incidents.
To the extent permitted by applicable law, the Services are provided on an “as available” basis, and ABU does not warrant that they will be uninterrupted, error-free or compatible with every device or system.
Information made available through the Services is provided for the purposes indicated in the relevant material. Unless expressly stated otherwise, it does not constitute legal, financial, technical or other professional advice and should not be treated as a substitute for advice appropriate to the circumstances.
ABU does not exclude any warranty, representation or condition that cannot lawfully be excluded or restricted.
To the extent permitted by applicable law, you shall indemnify ABU against reasonable losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising from a third-party claim to the extent directly attributable to:
ABU shall, where reasonably practicable, notify you of any claim for which indemnification is sought and provide reasonable cooperation in its defence.
No settlement that imposes an admission of liability or a non-monetary obligation on an indemnifying party shall be entered into without that party’s prior consent, such consent not to be unreasonably withheld or delayed.
This Section does not require you to indemnify ABU to the extent a claim results from ABU’s own breach of law, wilful misconduct or other conduct for which ABU is responsible.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law, including any liability that cannot lawfully be excluded or limited.
Subject to the preceding paragraph, ABU shall not be liable for indirect or consequential losses arising from the use of, or inability to use, the Services, including loss of profits, revenue, business opportunities or anticipated savings, where such losses are legally excludable.
Subject to applicable law, ABU’s liability for direct loss arising from the provision of the Services shall be assessed having regard to the nature of the claim, the circumstances in which the loss arose and any applicable contractual limitations.
Any applicable monetary limitation of liability must be expressly stated in the relevant contractual terms and interpreted in accordance with applicable law. No monetary cap shall apply under this Section unless one has been expressly specified in the applicable terms governing the relevant Service.
Nothing in these Terms limits liability for fraud or any other liability that cannot lawfully be limited.
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict-of-law principles.
The parties shall seek to resolve any dispute arising out of or in connection with these Terms through good-faith discussions.
Where a dispute remains unresolved, the parties may seek to resolve it through mediation by a mutually agreed mediator, subject to any applicable agreement and the requirements of applicable law.
Nothing in this Section prevents a party from seeking urgent interim or protective relief from a court of competent jurisdiction where necessary.
Subject to the foregoing and applicable law, the courts of Kuala Lumpur, Malaysia shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
ABU may amend these Terms from time to time to reflect changes in the Services, operational requirements, applicable law or other legitimate circumstances.
The current version shall be made available on the ABU website, together with the date on which it was last updated.
Where a change materially affects users’ contractual rights or obligations, ABU shall take reasonable steps to notify affected users where appropriate, including through the relevant online service or other suitable communication channel.
Changes shall take effect on the date specified in the updated Terms or in the accompanying notice, subject to applicable law and any required acceptance. Where a change requires express acceptance, continued use of the Services shall not substitute for that acceptance.
Severability. If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be applied to the extent legally permissible, and the remaining provisions shall continue in effect.
No waiver. A failure or delay by ABU in exercising a right under these Terms shall not constitute a waiver of that right.
Entire agreement. These Terms govern the use of the Services within their stated scope. They do not replace ABU’s Statutes, membership rules, separate agreements or applicable event-specific conditions.
Assignment. You may not transfer your rights or obligations under these Terms without ABU’s prior written consent, except where otherwise permitted by applicable law.
Interpretation. Headings are included for convenience and shall not affect the interpretation of these Terms.
