The National Broadcasting and Telecommunications Commission or NBTC is an independent regulatory body which was established under the Act on Organization to Assign Radio Frequency and to Regulate the Broadcasting and Telecommunications Services B.E. 2553 (2010) (“the Act”) . The NBTC Commissioners have been appointed on October 7th, 2011 to assign the nation’s radio frequency and to regulate broadcasting and telecommunications sectors for the benefit of the people and the public, as well as national security. In accordance with the second amendment B.E. 2560 (2017) of the Act, the NBTC shall be comprised of seven commissioners, having the knowledge and expertise in the area of (1) radio broadcasting (2) television broadcasting (3) telecommunications ) engineering (5) law (6) economics, and (7) consumer protection or the promotion of right and freedom of people.
The NBTC has levels of authority as followed: (1) Policy Making:
such as formulating Spectrum Management Master Plan, Broadcasting Master Plan, Telecommunications Master Plan, and Satellite and Orbital Right Management Plan (2) Rule Making: such as issuing licensing criteria and procedures and formulating broadcasting and telecommunications regulations, and (3) Implementing: such as issuing licenses for broadcasting and telecommunications services.
The Office of the NBTC is the secretariat office of the NBTC, having a Secretary General as the Chief of Staff. It is a juristic person, having a status of State agency. The Office of the NBTC is divided into 5 groups: Broadcasting, Telecommunications, Regional Affairs, Strategic and Internal Affairs, and Organization Administration. It has played a supporting role in driving the NBTC mission in order to bring the benefit in spectrum assignment and regulating the broadcasting and telecommunications services to the public. It also dedicates to promote free and fair competition under appropriate licensing measures and regulations that would ensure high quality telecommunications and broadcasting services throughout the country under reasonable and fair charges for Thai citizen.
